Terms of Service

These Terms govern your use of the TrueUser API and dashboard (the “Service”) operated by TrueUser, Inc. By creating an account, generating an API key, or calling the API you agree to them.
1. The Service
TrueUser scores email addresses for likelihood of fraud, disposability, role-account use, batch-attack patterns, and related signals, and returns a verdict driven by rules you configure in the dashboard. The Service is provided on a best-effort basis; verdicts are advisory and do not replace your own judgment.
2. Accounts and API keys
- You must provide accurate sign-in information and keep your account secure.
- API keys are bearer credentials. Treat them like passwords; rotate them if you suspect exposure.
- You are responsible for all activity issued under your account or API keys, including calls made by your users or downstream systems.
3. Acceptable use
You agree not to:
- Submit data without a lawful basis (you must have the right to evaluate the email addresses you send us, e.g. as part of your own signup, login, or fraud-review flow).
- Use the Service to enrich, profile, or build a directory of people outside the context of evaluating a user-initiated interaction with your product.
- Use verdicts as the sole basis for a legally significant decision (e.g. employment, credit, insurance, housing) without human review.
- Reverse-engineer, scrape, or attempt to derive the underlying model or detection lists.
- Probe, load-test beyond your plan’s rate limits, or otherwise interfere with the Service or other customers.
- Use the Service for any unlawful purpose or in violation of applicable export, sanctions, or privacy laws.
4. Customer data
The data your application sends to the API (“Customer Data”) remains yours. You grant TrueUser a worldwide, non-exclusive license to process Customer Data solely to provide and improve the Service, to meter usage, and to detect abuse. We do not use Customer Data to train any model, and we do not sell it. See the Privacy Policy for details on processing and sub-processors.
5. Fees and billing
- Free-tier usage is subject to monthly request quotas published in the dashboard.
- Paid plans are billed via Stripe in advance for subscription fees and in arrears for usage above your plan’s included quota.
- Fees are non-refundable except where required by law. Taxes are your responsibility unless we are required to collect them.
- We may change pricing on at least 30 days’ notice for the next billing cycle.
6. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, change features, or impose new rate limits as needed to keep the Service stable. If you have a written SLA with us, that document controls in case of conflict.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, if your account presents a security or abuse risk, or if required by law. Sections that by their nature should survive termination (fees owed, IP, disclaimers, limitation of liability, indemnification, governing law) will survive.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEUSER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VERDICTS WILL BE ACCURATE, THAT THE SERVICE WILL BE ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEUSER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) USD $100.
10. Indemnification
You will defend and indemnify TrueUser against any third-party claim arising from (i) your or your users’ use of the Service in breach of these Terms, (ii) Customer Data you submit, or (iii) your violation of applicable law.
11. Changes to these Terms
We may update these Terms. Material changes will be announced in the dashboard or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction.
